Your Rights

Defendants’ Rights:

The type of charges might dictate what kind of rights you have. Please call The Law Office of Tammy Riggs sooner than later to allow her to help you.

1. You have the right to a lawyer; defendants have the right to an attorney during the criminal legal proceedings.

2. You have the right to a speedy and public trial. At the trial, the defendant is presumed not guilty, and cannot be convicted unless the fact finder is convinced of the defendant’s guilt beyond a reasonable doubt.

3. You have the right to have your lawyer cross-examine all witnesses that testify against you.

4. You have the right to remain silent and not discuss a crime under investigation to preserve your right against self-incrimination.

5. You have the right to have your case proven by the state to be beyond a reasonable doubt. Defendants in a criminal case have absolutely no burden of proof as to their guilt or innocence.
